PUBLIC NOTICE

SUBSTITUTED TRUSTEE’S NOTICE OF SALE

WHEREAS, on August 29, 2002, Barbara B Barnes executed a Deed of Trust to Stephen R. Colson, Trustee for Creve Coeur Mortgage Associates Inc., Lender, which Deed of Trust was recorded in the office of the Chancery Clerk of Jefferson Davis County, Mississippi in Instrument No. 0203499 at Book 477, Page 466; and,
WHEREAS, Creve Coeur Mortgage Associates Inc. assigned said Deed of Trust to JPMorgan Chase Bank as Trustee, c/o Residential Funding Corporation, by Assignment of Mortgage dated October 9, 2002, recorded April 18, 2003, in Book 482, Page 352, in the office of the Chancery Clerk of Jefferson Davis County, Mississippi; and,
WHEREAS, The Bank of New York Mellon Trust Company, National Association, as Trustee, f/k/a The Bank of New York Trust Company, N.A., as Trustee, as Successor to JPMorgan Chase Bank N.A. as Trustee by Residential Funding Company, LLC f/k/a Residential Funding Corporation, its Attorney-in-Fact, assigned said Deed of Trust by Corporate Assignment of Deed of Trust dated September 10, 2012, recorded October 2, 2012, in Instrument no. 12001952 at Book 0544, Page 106, in the office of the Chancery Clerk of Jefferson Davis County, Mississippi, and,
WHEREAS, Residential Funding Company, LLC fka Residential Funding Corporation executed an Assignment of Deed of Trust dated June 7, 2013, recorded July 11, 2013, in Book 548, Page 496, in the office of the Chancery Clerk of Jefferson Davis County, Mississippi; and,
WHEREAS, pursuant to that certain Limited Power of Attorney dated February 6, 2013, GMAC Mortgage, LLC and Residential Funding Company, LLC appointed 21st Mortgage Corporation as their Attorney-in-Fact, with full authority to, among other things, execute substitutions of trustee under deeds of trust in connection with mortgage loans in which 21st Mortgage Corporation holds the servicing rights, which Power of Attorney is of record in the office of the Chancery Clerk of Jefferson Davis County, Mississippi; and,
WHEREAS, under the terms of said Deed of Trust, the beneficiary is authorized and empowered to appoint and substitute another trustee in the place and stead of the trustee named therein.
NOW, THEREFORE, 21st Mortgage Corporation, acting in its capacity as beneficiary and/or as Attorney-in-Fact for Residential Funding Company, LLC fka Residential Funding Corporation, pursuant to the Limited Power of Attorney referenced above, and acting by and through its duly authorized officer, does hereby appoint Jeff D. Rawlings as Substitute Trustee under said Deed of Trust, and does hereby confer upon Jeff D. Rawlings full and complete power to execute said trust as Trustee as provided by the terms of the aforesaid Deed of Trust. The Substitution of Trustee was recorded in Instrument No. 26000727 at Book 2026, Page 4313 through 4314; and,
WHEREAS, default having been made in the terms and conditions of said Deed of Trust and the entire debt secured thereby having been declared to be due and payable in accordance with the terms of said Deed of Trust, 21st Mortgage Corporation, the legal holder of said indebtedness, having requested the undersigned Substituted Trustee to execute the trust and sell said land and property in accordance with the terms of said Deed of Trust and for the purpose of raising the sums due thereunder, together with attorney’s fees, trustee’s fees and expenses of sale.
NOW, THEREFORE, I, Jeff D. Rawlings, Substituted Trustee in said Deed of Trust, will on the 30th day of July, 2026, offer for sale at public outcry and sell within legal hours (being between the hours of 11:00 a.m. and 4:00 p.m.), at the main front door of the Jefferson Davis Courthouse, located at 2335 Columbia Avenue, Prentiss, Mississippi to the highest and best bidder for cash the following described property situated in Jefferson Davis County, State of Mississippi, to-wit:
3.5 ACRES OF LAND, MORE OR LESS SITUATED IN AND BEING A PART OF THE NEI/4 OF SWI/4 OF SECTION 8, TOWNSHIP 7 NORTH! RANGE 19 WEST, JEFFERSON DAVIS COUNTY, MISSISSIPPI DESCRIBED AS: COMMENCING AT THE POINT WHERE THE WEST BOUNDARY LINE OF THE SAID NEI/4 OF SWI/4 INTERSECTS THE SOUTH MARGIN OF US. HIGHWAY NO. 84, THENCE RUN EAST ALONG AND WITH SAID SOUTH MARGIN OF SAID HIGHWAY A DISTANCE OF 577.5 FEET TO AND FOR THE POINT OF BEGINNING, THENCE RUN SOUTH 462 FEET, THENCE RUN EAST 330 FEET; THENCE RUN NORTH 462 FEET TO THE SAID SOUTH MARGIN OF SAID HIGHWAY THENCE RUN WEST ALONG AND WITH SAID MARGIN OF SAID HIGHWAY A DISTANCE OF 330 FEET TO THE POINT OF BEGINNING.

HIGHWAY NO. 84; THENCE RUN N 89° 25’ 50” W 132.117m (433.45 FEET) ALONG SAID RIGHT-OF-WAY LINE TO THE POINT OF BEGINNING; THENCE RUN S 00° 19’ 58” W 53.658m (176.04 FEET); THENCE RUN S 89° 08’ 35” W 100.656m (330.23 FEET); THENCE RUN N 00° 19’ 58” E 56.148m (184.21 FEET) TO THE SOUTHERLY RIGHT-OF-WAY LINE OF OLD U.S. HIGHWAY 84; THENCE RUN S 89° 26’ 58” E 100.635m (330.16 FEET) ALONG SAID RIGHT-OF-WAY LINE, BACK TO THE POINT OF BEGINNING, SAID PARCEL CONTAINING 0.552 HECTARES (1.36 ACRES), MORE OR LESS AND BEING LOCATED IN THE NEI/4 OF THE SWI/4 OF SECTION 8 TOWNSHIP 7 NORTH, RANGE 19 WEST, JEFFERSON DAVIS COUNTY, MISSISSIPPI.
